Clients are responsible for ensuring that they have appropriate authority to provide Personal Information to Phalyda.

How We Collect Personal Information

We may collect Personal Information directly from you when you visit our website, contact us, submit an enquiry, request information, complete a form, subscribe to communications, become a client, use a Phalyda service, attend a meeting or event, communicate with our team, apply to work with us, interact with our social-media channels or otherwise deal with Phalyda.

We may also receive Personal Information from clients, referrals, business partners, contractors, service providers, publicly available sources, professional networks, social-media platforms, analytics providers, technology platforms and other third parties where permitted by law.

We aim to use AI and automated systems responsibly and with appropriate human oversight having regard to the nature and risk of the activity. Where Personal Information is processed using third-party AI or technology providers, we take reasonable steps appropriate to the circumstances to assess how that information is handled.

We do not intend AI-generated output to replace appropriate human or professional judgement where a decision requires such judgement. Where applicable law requires specific disclosures concerning automated decision-making, Phalyda will provide those disclosures.

We may disclose Personal Information where reasonably necessary to employees and authorised personnel, contractors and consultants, technology providers, cloud-hosting providers, software and CRM providers, communications providers, AI service providers, analytics providers, professional advisers, accountants, legal advisers, payment providers, business partners, suppliers, clients where relevant to service delivery, regulators and government authorities, and other parties where authorised or required by law.

We seek to limit disclosures to what is reasonably necessary for the relevant purpose.

Phalyda relies on third-party technology and infrastructure to operate its business, including cloud infrastructure, hosting, CRM, email, telecommunications, analytics, artificial intelligence, automation, accounting, payment processing, project management, document management, cybersecurity and other business systems. Those providers may process information in accordance with their own contractual and privacy obligations.

Overseas Disclosure and Processing

Some of Phalyda's service providers, technology providers, contractors or infrastructure may be located outside Australia or may process information using overseas infrastructure. As a result, Personal Information may in some circumstances be disclosed to or accessible from overseas.

The countries involved may vary depending on the technology, supplier, client engagement and service being provided. Where Australian privacy law applies to an overseas disclosure, Phalyda will take reasonable steps required by applicable law in relation to that disclosure. Where reasonably practicable, our privacy documentation will identify countries in which overseas recipients are likely to be located.

Data Security

Phalyda takes reasonable steps appropriate to the circumstances to protect Personal Information from misuse, interference, loss, unauthorised access, unauthorised modification and unauthorised disclosure.

Measures may include access controls, authentication, role-based permissions, security policies, technology controls, secure cloud infrastructure, employee and contractor obligations, monitoring, backups, incident-management procedures and other organisational and technical measures. No internet-based system can be guaranteed to be completely secure.

Data Breaches

Phalyda maintains processes for responding to suspected privacy and security incidents. Where the Notifiable Data Breaches scheme or another applicable law requires notification of an eligible data breach, we will take the steps required by that law, which may include notifying affected individuals and the Office of the Australian Information Commissioner.

Data Retention

We retain Personal Information for as long as reasonably necessary for the purposes for which it was collected, providing services, maintaining appropriate business records, legal and regulatory obligations, dispute management, security, backup and recovery and other legitimate business requirements.

When Personal Information is no longer required and we are not legally required to retain it, we will take reasonable steps to destroy it or de-identify it.
